Mobile Homes Act 2013

The Mobile Homes Act 2013 received Royal Assent on 26th March. Sections 9 to 12 came into force on Monday 26th May along with the Mobile Homes (Selling and Gifting) (England) Regulations 2013.

The Act introduces a new procedure for the sale (or gifting) of a mobile home involving formal notice to the park owner and limiting the scope for site owners to refuse sales without showing good cause to the Residential Property Tribunal.

The Act also limits the commission that can be charged by the park owner. The commission is paid by the buyer and cannot exceed 10%.  There are new requirements as to the information to be provided by the seller, and by the buyer, both to one another and to the park owner. There is also a prescribed form of assignment.

There is provision for regulations to be made in respect of Site rules with the intention that they will in due courts become registered with the local authority.

There are also new provisions for alterations to pitch fees. The review notice must be accompanied by certain prescribed information or the notice will be invalid.

There are new provisions, to come into effect in April 2014, giving local authorities more powers in relation the licensing of sites.
